Rocket Caravans - Warranty
Terms and Conditions
1. General
a. Rocket Caravans New Zealand Ltd (Rocket) provides the following warranty in relation to Rocket Caravans. The benefits of this warranty are in addition to those guaranteed by the New Zealand Consumer Guarantees Act (CGA). Rocket is also governed by and adheres to the New Zealand Fair Trading Act (FTA). This warranty, terms and conditions are subject to the laws of New Zealand and are subject to the exclusive jurisdiction of the Courts of New Zealand.
b. All new caravans come with a manufacturer warranty for the Body Shell, Chassis, Factory Fitout and Appliances. Further details of these the warranty are below.
c. Your warranty may be deemed void if used for a purpose other than the intended purpose for which it was sold.
d. Your warranty may be deemed void if the Warrant of Fitness (WoF), Warrant of Electrical Fitness (EWoF), or Gas Certificate (GWoF) are not kept current.
e. The owner/purchaser or any other person shall not assign the benefit of the warranty without the prior written consent of Rocket.
f. The caravan itself (for the avoidance of doubt, not the appliances and any accessories) is warranted by Rocket as described in this warranty document.
g. To the extent possible, Rocket will reasonably endeavour to pass on all manufacturer warranties relating to the installed appliances and any accessories (for the avoidance of doubt, not the caravan itself) and will make reasonable efforts to ensure the manufacture honours such warranties.
h. We reserve the right to make minor changes to our products from those shown and listed. These changes would be to reflect any relevant law or regulatory requirements changes and to implement any minor technical improvements and/or adjustments.
i. Products presented for repair may be replaced by refurbished products of the same type rather than being repaired. Refurbished products may be used to repair the products.
j. We are not responsible for delays outside of our control. If our supply is delayed by an outside event, then we will contact you as soon as possible to inform you and we will do our best to minimise any adverse effects.
k. All warranties are “Return to Base.” This means that for any warranty claims, the caravan would need to be brought back to Rocket or a Rocket specified authorised service centre for repairs during normal business hours. Under NO circumstances do we cover repair invoices from unauthorised service centres without prior written agreement from Rocket.
l. Rocket makes no express warranties or representations other than as set out in this warranty document. This warranty does not apply to, nor shall Rocket have any liability or responsibility for, damages or expenses relating to defects caused by misuse, abuse, or failure to maintain the products.
m. Rocket shall NOT have any liability or responsibility in respect of damages or expenses relating to:
i. defects in material or workmanship that did not exist when the product was first delivered;
ii. defects in material or workmanship that become manifested beyond the warranty period;
iii. defects which are not reported to Rocket within sixty (60) days of discovery;
iv. a product that has been altered or modified from factory specifications;
v. accidents, misuse, abuse, abnormal use, improper use, lack of reasonable or proper maintenance;
vi. installation, wiring, service, or repairs improperly performed or replacement parts or accessories not conforming to Rocket’s specifications;
vii. normal wear or deterioration caused by the use of the product or its exposure to the elements;
viii. loss of time, loss of use, inconvenience, travel expense, costs related to procuring any substitute product, transportation costs, any incidental or consequential damages arising out of the non-use of the product, or compensation for inconvenience or loss of use while the product is being repaired or otherwise not available, or other matters not specifically covered hereunder;
ix. the costs or expenses associated with transporting the product to and from Rocket or a Rocket authorised service centre, or storage of the product even where this is necessary to conduct the warranty service.
x. any delay in either replacing or remedying the workmanship or in properly assessing the owner’s claim;
xi. any items or issues listed, detailed, or implied in Section 3 of this warranty document, “Not Covered under Warranty”.
n. The repair or replacement of the products supplied by Rocket is the absolute limit of Rocket’s liability under this warranty. Except where expressly provided by New Zealand law, Rocket shall not be responsible for any incidental or consequential damages or other costs, whether the claim is based in contract, tort or otherwise, including but not limited to: any costs, taxes, fees, levies, or other expenses. The statements of warranty are exclusive and in lieu of all other remedies.
